On Wednesday, the Supreme Court emphasized that there should be no discrimination in providing education, including for children of Rohingya immigrants who are facing challenges in gaining school admissions. The Supreme Court was hearing a public interest litigation filed by the NGO, Rohingya Human Rights Initiative, seeking directives to ensure that Rohingya Refugees are granted school admissions and government benefits without the requirement of Aadhaar cards and regardless of their citizenship status.
Nothing that there should not be any discrimination over the education of children, the Bench of Justice Surya Kant and Justice N Kotiswar Singh directed the NGO to furnish address proof of Rohingya immigrants living in Delhi, so that it could check the relief that could be extended to them.
The Bench, consisting of justices Surya Kant and NK Singh, heard the matter briefly, with the court affirming that there should be no discrimination in terms of education. Senior Advocate Colin Gonsalves, representing the petitioner, described the dire situation faced by the Rohingya refugees, nothing is hard in securing school admissions. The Court Requested information confirming the refugee’s current place of residence to see possible comfort options. It stresses that the personal details of Minor children should not be disclosed, but the focus should be on the parent’s residence, including proof of location like house numbers and family lists.
Supreme Court in PIL Seeking gov. school Admission for Rohingya kids
In the PIL seeking government benefits and school admissions for Rohingya refugees, the Supreme Court Today said that education shall be provided to all children without discrimination, Senior Advocate Colin Gonsalves, Appearing for the petitioner organisation, contended that Rohingya refugees were facing a desperate situation. All the refugee children were not able to get admission to Delhi. When the Apex Court sought their residential details, Gonsalves said the Rohingyas had cards issued by the United Nations High Commissioner for Refugees that recognised their refugee status.
Asking the petitioner to give information related to the residential status of the Rohingya refugee families the Court had earlier said that from there only The “Right to education Will flow” IN other matters similar relief it had indicated
During Today`s hearing Senior Advocate Colin Gonsalves presented the information sought by the Court. The same listed the number of Rohingya refugee families staying in Shaheen Bagh, Kalindi Kunj and Khajuri Khas. Before the matter of the court parted with the matter, Gonsalves drew its attention to the Union of India`s stance in an earlier case that Rohingyas have a right to go to public schools and public hospital.
The Bench then observed that once the details related to the surroundings and living conditions of Rohingya immigrants were submitted, it would look into how to extend relief. The matter will be heard again on February 28.
Earlier, the Delhi High Court had dismissed a similar petition seeking school admissions for Rohingya children, directing the petitioner to approach the Union Ministry of Home Affairs instead. The High Court had noted that the Court should not serve as the medium for resolving such issues. An appeal related to the case is currently pending before the Supreme Court. The petition was last heard on January 27, where the Court granted additional time to the petitioner to submit Details of Rohingya families living in regular residential areas instead of makeshift camps. This matter will be heard again on Feb. 17.
